Terms & Conditions – Trading
Any acceptance by us of an order is subject to the following conditions:

1. Quotations Quotes are supplied on the basis of information supplied by the customer. The price quoted shall be honoured for 7 days, provided that this information is accurate. All prices displayed on this website are including VAT unless otherwise indicated.

2. Ordering & Deliveries Upon receipt of an order (by phone or fax or e-mail) we will send written confirmation by post or fax or e-mail. This must be checked, signed and returned with payment, as applicable (see below). Upon receipt of this signed document by us, the contract for our sale and your purchase of the goods shall be made. We aim to deliver and/or install goods within 7 days of receiving your order, although depending on stock turnaround this may take up to 28 days. You will be informed of expected timescale changes.

3. Availability & Substitution All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. In the event that your choice of product is unavailable Yorkshire Garage Doors shall endeavor to find an adequate substitute, of which you will be notified before dispatch. We cannot be held responsible for contingencies beyond our control such as strikes, lockouts, shipping delays, fire, war etc. All confirmed orders may be partially or wholly suspended without liability on our part. In such an event the purchaser will have no claim against us for loss or damage either direct or consequential which may result.

4. Payment - 1) Terms Payment must be made in full before dispatch, unless Supply & Installation where payment may be made upon delivery on condition that prior arrangements have been made with Yorkshire Garage Openers. 2) Non-Payment We reserve the right to charge interest on overdue accounts at the rate of 3% above Lloyds Bank Base Rate. Plus any legal or other costs involved in the collection of such outstanding accounts. 3) Retention of Title Notwithstanding delivery, the goods shall remain the property of the company (which reserves the right to dispose of them), until the company has received payment of the full price of (a) all goods the subject of this contract and (b) all the goods supplied by the company to the customer under any other contract whatsoever. If the goods are altered or any goods become attached to the goods or if any part of the goods is replaced, such other goods or replacement parts shall accede to and form part of the goods.

5. Returns Once satisfactory delivery has been taken, refunds or exchanges can be given in accordance with your legal rights. After you have received the goods, you may, with our prior authorization, return them within 7 days provided that the product is returned to our distribution address, unused and in the original packaging, along with the delivery note. Return costs are the responsibility of the customer except where the goods are found to be faulty, whereupon Yorkshire Garage Doors will arrange for return (see below).

6. Faulty Goods If your product appears to be faulty and is in-warranty, Yorkshire Garage Openers will endeavor to diagnose and remedy any defect either by telephone or e-mail, or by site visit at our convenience. If it is determined that the goods are faulty they will be either a) repaired on-site or b) replaced. We endeavor to do this within 7 days. Any fault due to MATERIAL or STRUCTURAL defect will be replaced FREE of CHARGE or credited in full at our discretion. Under no circumstances will we accept liability for consequential loss or damage or pay for any repairs or alterations without prior authorization.

7. Guarantee All products are supplied and guaranteed in accordance with the manufacturer’s specifications. Individual product warranties can be found in detail at the manufacturers website or by request from Yorkshire Garage Openers. It is strongly recommended that you read the full warranty relating to your chosen product before purchase. Some relevant warranties can be found at www.merlingo.com, www.waynedalton.co.uk, www.steel-line.co.uk/, www.hormann.co.uk. In the event of a guarantee claim, notification must be both verbal and written immediately a fault is discovered. The purchaser must provide full particulars and facilities to enable us to verify the claim. Wherever possible parts are to be returned to us accompanied by the appropriate paperwork, carriage paid for inspection by manufacturer or us. In addition, all relevant manufacturer’s warranty documents must be completed in full and in accordance with the guidelines given by the relevant manufacturer.

8. Claims & Complaints Will be dealt with according to each manufacturers own guidelines in a fair and confidential manner.
Claims arising from shortages must be notified within 24 hours; goods received in damaged condition, (if delivered by carrier original packaging must be kept for claim to be considered) must be notified within 24 hours; goods incorrectly supplied must be notified within 24 hours; non-delivery by a courier of a consignment or part thereof, must be notified within 48 hours of the despatch date shown on the invoice and confirmed in writing within 7 days.

3. Security Online orders are processed using securely encrypted PayPal(c) transactions. As such any claims against loss or theft of data, etc are the sole responsibility of PayPal(c) . All forms on this site are returned to us via e-mail. As e-mail is not a fully secure method of communication any material which you transmit to the web site and which is intercepted by unauthorized users (“hackers”) will not be the responsibility of this company. If you have concerns regarding completing our online quotation form, please contact us using the appropriate details provided to arrange an alternative method.
